Terms and Conditions

Version: 23 October 2026

Poplex is operated by Poplex Technologies LLC — A Wyoming Limited Liability Company, United States ("Poplex," "we," "us"). Our public contact location is Sheridan, Wyoming, United States. Contact us at support@poplextcg.com for account, billing, legal, privacy or rights questions. The location identifies our city and state; it is not a postal delivery address or an address for service of process.

1. Agreement and eligibility

These Terms and Conditions ("Terms") govern your organization's access to the Poplex website, API, documentation, account tools and related services ("Services"). "You" means the organization or sole proprietor accepting these Terms and its authorized users. "Catalog Data" means the card, set, printing, species, illustrator, language and related metadata returned through the Services. "Images" means card scans, artwork and other third-party visual material identified or delivered through the Services.

Accept these Terms affirmatively when creating an account or obtaining API access. A paid order also requires your affirmative agreement to the price, billing interval and renewal terms displayed before payment. Your agreement begins when you accept it. Merely reading our public website does not create a paid subscription.

At launch, accounts and paid purchases are offered to businesses and developers in the United States for business or professional use. You must be at least 18, have reached the age of legal majority where you live, and have authority to bind the customer organization. Do not misstate your location, business status or authority. The Services are not directed to children. We may decline an account or purchase we cannot lawfully support. These restrictions do not remove any protection that applicable law gives an individual.

A signed enterprise agreement controls over these Terms only to the extent it expressly changes them. The Refund and Cancellation Policy governs refunds, cancellation, grace periods and plan-change billing; it controls over a conflicting general statement in these Terms. A confirmed order controls the purchased price, interval, allowance and expressly agreed features. These Terms otherwise control. Documentation explains technical operation and cannot silently reduce a purchased entitlement. Our Privacy Notice explains personal information practices and does not grant a license to Catalog Data or Images.

2. Accounts and credentials

Give us accurate organization, contact and billing information and keep it current. Control who may act for your organization. Keep API keys and passwords confidential, store API keys on a trusted server, and do not publish them in client code, repositories or public logs. Do not share a key with an unrelated customer organization. Contractors may use access solely on your behalf under confidentiality and security obligations; you remain responsible for their authorized use.

Notify support@poplextcg.com promptly if you suspect a compromised account or key. Revoke or replace exposed credentials. You are responsible for activity you authorize or cause through your account; that does not excuse our own failure to meet obligations imposed on us by law. We may verify authority, restrict a compromised key or temporarily suspend access to protect customers or the Services.

3. Service and data permission

Subject to these Terms and the purchased plan, we permit you to access the Services and use Catalog Data within your own applications, websites, internal tools and customer-facing products. This includes commercial applications, a private backend serving your own application, and reasonable server-side caching. The Free plan may be used to evaluate a business application within its limits. A higher plan buys the allowance and features shown in its order; it does not buy ownership of the catalog or an artwork license.

This permission is nonexclusive and nontransferable, except to contractors operating solely for you as described above. End users may view card-level results through your product; they do not receive credentials or a right to extract the Poplex catalog as a data source. Unless a separate signed agreement permits it, do not operate a substitute public API, resell or sublicense our feed, publish a bulk catalog dump, or offer unrestricted dataset exports obtained through the Services. Ordinary requests made within your plan to operate your product are permitted; observing a rate limit does not itself authorize redistribution.

You may retain and serve cached Catalog Data while your account remains active on a plan that permits that use. If you close the account or lose that permission, stop serving the affected Poplex-sourced records and remove them from active caches within 30 days. Retain only records needed for legal compliance, dispute evidence or restricted backups; do not use those retained copies to serve your product. You may keep your independently obtained facts, customer records, mappings and genuinely original analysis that does not reproduce our catalog. On a downgrade, remove only material no longer permitted by the new plan. Image use is governed separately by section 4.

We claim rights only in material we own or are entitled to license, including our software and original organization or additions where protected. We do not claim ownership of independent facts, third-party artwork or your own materials. Separate open-source or third-party licenses continue to govern material covered by them; these Terms do not revoke rights those licenses independently grant. Preserve applicable source and license notices.

4. Card images and third-party rights

Subscriptions pay for the hosted API service, organization of information, delivery capacity and included features. Some plans may include image URLs or image delivery as an identification feature. Payment does not convey copyright, trademark rights or a sublicense in Images. We do not sell Pokémon artwork or claim to own it. The fact that an image is reachable, returned by an API, credited to an artist or included in a paid feature does not establish permission to reproduce it.

Images are presented to identify and discuss the specific cards they depict. To the extent Poplex controls access to its delivery systems, your plan allows you to request included image resources for that purpose. That access permission is separate from any rights needed in the image itself. Display, caching, downloading or self-hosting is permitted only to the extent you have an independent lawful basis for the particular use, including any required permission from the rights owner. Our Terms do not supply that basis. You can use Catalog Data without displaying Images.

We do not authorize standalone image packs, bulk image mirrors, artwork resale, merchandise, counterfeit cards, removal of rights notices, misleading endorsement claims, or use of Images to train a model. Do not crop artwork away from its card context, alter it or use it as product branding on the strength of your Poplex subscription. Any separate rights you hold must cover that use independently. Keep existing artist credits and copyright notices visible when lawfully displaying a card. Attribution is not a substitute for permission.

Images and their URLs can be corrected, restricted or withdrawn for rights, source or operational reasons. Do not assume permanent availability or bypass an access restriction. If we identify withdrawn content, stop requesting or serving it and remove active cached copies promptly, ordinarily within 72 hours of notice or sooner where the notice or law requires. Keep any necessary legal evidence restricted from public access. A material loss of paid functionality is addressed under the Refund and Cancellation Policy.

Pokémon names, card text, artwork, characters and associated marks belong to their respective rights owners. Poplex is an independent service and is not affiliated with, sponsored, endorsed or approved by Nintendo, The Pokémon Company, Creatures Inc. or GAME FREAK. A source attribution, illustrator credit or public availability is not evidence of such a relationship.

Send rights complaints to support@poplextcg.com with the subject "Rights complaint." Identify the protected work, the exact Poplex URLs or record identifiers, your claimed rights and authority, your contact details, and the requested action. For a copyright removal notice, also provide your physical or electronic signature, a good-faith statement that the challenged use is not authorized by the owner, its agent or law, and a statement under penalty of perjury that the notice is accurate and you are the owner or authorized to act for the owner. We review notices, may request evidence, may restrict material during review, and comply with binding legal orders. A source operator may have its own rights; a bare objection without demonstrated rights does not automatically decide ownership. This contact process does not represent that Poplex has registered a DMCA agent or qualifies for a statutory safe harbor.

5. Plans, quotas and rate limits

Standard monthly request allowances are Free: 1,000; Pro: 25,000; Business: 100,000. Enterprise allowances are set in a signed order. Business purchases require prior contact; Enterprise requires a quote. The order and pricing presented before purchase specify price and included features. Do not purchase a plan on the assumption that every record has an image or English name.

Allowances reset at 00:00 UTC on the first day of each calendar month for all standard plans, independently of your payment anniversary. Unused requests do not roll over. There is no separate daily allowance, automatic overage charge or automatic conversion from Free to a paid plan. Requests beyond the monthly allowance receive HTTP 429 until reset or a confirmed increase in allowance. We send notices when recorded usage reaches 80% and 95%; delivery delays do not increase the allowance.

One successful standard API response in the 2xx range counts as one request, including each page fetched from a list. Responses in other ranges, including 304, 4xx, 429 and 5xx, do not consume the monthly allowance. Image downloads from the image delivery host do not consume this request allowance. This does not authorize unlimited image scraping. Requests across your organization's keys share its monthly allowance. Retries that produce another successful response count again.

Short-window limits are 30 requests per 10 seconds for Free, 100 per 10 seconds for Pro, and 300 per 10 seconds for Business, applied per API key at a Cloudflare location. Enterprise limits follow its order. These controls are approximate local protection, not a guaranteed global request rate, and may temporarily operate in a reduced mode during a limiter failure. Separate security and network protections may reject requests earlier. A short-window rejection does not itself mean the monthly allowance is exhausted. Honor HTTP 429 and any Retry-After value, use backoff, and avoid rapid repeated retries. We may impose temporary proportionate restrictions to respond to abuse, an incident or a legal obligation.

6. Acceptable use and customer materials

Do not infringe rights; create counterfeit products; provide unlawful content; introduce malware; probe or bypass access controls; interfere with other users; disguise abusive traffic; or split activity among accounts to evade limits. Report suspected vulnerabilities privately to support@poplextcg.com. Do not send passwords, payment card details, sensitive personal information or personal data about your end users in API searches. The public catalog API is not a service for storing your customers' personal data.

You retain rights in material you send to support. You authorize us and our service providers to process that material only to answer the request, operate and secure the Services, and comply with law. Do not send content you lack authority to share. This does not grant us a right to sell your content or train a general-purpose model on it. A future image-upload or scanning service requires its own disclosed terms and privacy treatment before launch; these Terms do not describe one as currently available.

7. Accuracy and availability

Catalog Data can contain omissions, mistakes and conflicting source information. Verify information important to your product. An English name supplied for a Japanese card can be derived or matched rather than the title of an officially corresponding English printing. A name or species match does not prove that two printings are equivalent. Consult any basis, confidence and provenance fields supplied. Missing names, images or relationships may remain missing. Illustrator credits describe catalog records and do not establish an artwork license. Rarity groupings are derived classifications rather than a universal official scale.

We do not guarantee complete coverage, permanent image availability or error-free operation. Unless a signed order says otherwise, there is no service-level agreement or guaranteed uptime. The Services do not authenticate a physical card, guarantee its grade or supply an appraisal, investment, legal or tax opinion. Assess the fitness of the information for your purpose.

We may correct records and make additive changes to v1. Planned breaking API changes will use a new major version. We give at least 30 days' notice of a planned material withdrawal of paid functionality or major-version retirement when reasonably practicable. Security, rights or legal requirements can require earlier action; we notify affected customers as soon as practicable and apply the Refund and Cancellation Policy where relevant. This paragraph does not promise an unchanging underlying catalog.

8. Billing and renewal

Paid plans are billed in advance at the price and recurring interval you expressly approve. Standard subscriptions are monthly unless a signed order states otherwise. Applicable taxes and the total due are shown before confirmation. Poplex is the seller; Stripe processes payments. Do not send payment card numbers to Poplex support. A payment provider's processing role does not replace our refund obligations.

Your subscription renews automatically until cancelled. You can cancel through account billing controls or by emailing support@poplextcg.com. The Refund and Cancellation Policy states the complete rules for first-payment refunds, incorrect charges, service failures, rights withdrawals, proration, failed-renewal grace and cancellation. It is part of this agreement and must be made available before purchase. We do not charge late fees or unapproved overages. Any prepaid enterprise arrangement must state its own billing terms expressly.

9. Suspension and termination

You may cancel a paid subscription without closing the account. You may request account closure at support@poplextcg.com. We may suspend affected access immediately where reasonably necessary for compromised credentials, fraud, serious abuse, a rights issue or law. When lawful and practicable, we explain the reason and allow a reasonable opportunity to correct a remediable breach. Nonpayment follows the grace rules in the Refund and Cancellation Policy.

We may terminate for a material breach not corrected within 10 days after notice, or immediately for an irremediable serious breach or legal requirement. If we discontinue an account for our convenience, we give 30 days' notice where practicable and refund prepaid fees for the unused period. We do not retain money that the law or our Refund and Cancellation Policy requires us to return. Termination does not erase accrued payment duties, independent third-party rights or the clauses that by their nature continue, including confidentiality, permitted retention, liability and dispute terms.

10. Warranties and allocation of risk

EXCEPT FOR EXPRESS COMMITMENTS IN THESE TERMS, THE REFUND AND CANCELLATION POLICY OR A SIGNED ORDER, THE SERVICES AND CATALOG ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THIRD-PARTY CONTENT IS LICENSED FOR YOUR PARTICULAR USE. THIS DISCLAIMER DOES NOT CREATE RIGHTS THAT POPLEX LACKS OR EXCUSE OUR OBLIGATIONS UNDER NONWAIVABLE LAW.

To the extent permitted by law, neither party is liable to the other for indirect, special, incidental or consequential damages, including lost profits or anticipated savings. Poplex's aggregate liability arising out of or relating to these Terms or the Services is limited to the greater of US$100 and the fees you paid Poplex for the Services during the 12 months before the event first giving rise to the claim. Related claims share one cap; the cap does not multiply per incident or user.

These exclusions and the cap do not limit liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or liability that applicable law does not allow a party to limit. They do not reduce refunds expressly due under our policies or excuse payment of undisputed fees. Mandatory statutory remedies remain available.

For business customers, you will defend Poplex against a third-party claim arising from your unlawful use of the Services, material you supplied without the necessary rights, or your knowing violation of these Terms, and pay resulting damages and reasonable defense costs finally awarded or agreed in a settlement you approve. This does not cover claims caused by Poplex's breach, misconduct or infringement in unmodified material Poplex supplied. We must notify you promptly, reasonably cooperate, and let you control the defense with competent counsel. You may not settle by admitting fault for Poplex or imposing nonmonetary duties on it without its consent, which will not be unreasonably withheld. Delayed notice reduces this obligation only to the extent it materially prejudices the defense.

11. Changes and notices

We give at least 30 days' advance notice by account email of material changes to these Terms or a subscription price. A price increase applies only at a renewal on or after the notice period; you can cancel beforehand. We do not retroactively change an incurred price or an accrued refund right. Changes required sooner by law or urgent security needs may take effect sooner with an explanation. Obtain fresh affirmative agreement where law requires it. If you reject a material change, cancel before it takes effect; your existing prepaid period remains governed by the terms on which it was purchased unless law requires otherwise.

Keep a working account email. Routine operational notices may also appear in the account interface. Legal and privacy notices may be sent to support@poplextcg.com; a delivery acknowledgment does not by itself accept a legal claim or constitute service of process. A waiver must be explicit; a failure to enforce once is not a continuing waiver. You may not transfer the agreement without our consent, except as part of a bona fide business succession where the successor assumes it. We may transfer it as part of a merger, reorganization or business sale, subject to existing obligations and applicable privacy law. If a provision is unenforceable, the remainder continues to the extent lawful.

12. Governing law and courts

These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by, and construed in accordance with, the laws of the State of Wyoming, United States, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the federal or state courts located in the State of Wyoming, subject to applicable laws governing jurisdiction and venue. Nothing here removes a mandatory protection, forum or remedy that applicable law does not permit you to waive. These Terms do not require arbitration or waive class proceedings.
